Accused of Slander and Libel for What a Friend Wrote (Accidents & Personal Injury Law)

Wed, 06 Apr 2005 06:20:00 GMT

Recently I had a relationship with a married man. A friend of mine saw him as having taken advantage of me. My friend wrote to this married man's wife at her work via email. She sent two emails to his wife, to tell her of the details of our affair. This married man is now threatning to sue me for slander. I have seen the emails there is nothing slanderous in them, only saying what happened between him and I over the last six months. He said that the legal team at his wife work are looking for ways to sue me too. I have copies of emails, texts, and cards from him that state what our relationship was, and how he felt about me. I went to the police today because he has threatened to come after me, and make my life hell, and to pay me back big time. He said it does not matter what it costs him he is going to get me. I know that my friend should not have sent the emails but we can't change that now. Can somebody please tell me, does he have a case against me? Thank you.

  • So the claim would be against you because of what you said to your friend? Because if your friend sent the letters, and you had nothing to do with that, your liability could only flow from what you told your friend as opposed to the content of the letters themselves.

  • I am going through the exact same thing with an ex co-worker who got me fired for an email I sent to him calling our supervisor a name. He took it to our GM and she fired me. I emailed him and called him and snake, and he took that email to our GM as well, and she forwarded my email to the legal department at work and now I'm worried, but after researching online I've found that if what was said or written is found to be true (let's face it, this guy is a snake, he acted like my friend and then took my email to the boss... how immature is that) there is no grounds for libel. Second of all, calling someone a snake is not that bad of a name anyway. In your case, if you had made up a bunch of lies that weren't true, he would have a case against you, but if you told what was the truth, he does not have a case against you. Don't worry about it girl! =)

  • well #1, it wouldn't be slander, it would be libel.... slander is spoken, libel is written.

but i'm thinking as long as the contents of the emails were true, it's not libel bc it's true.... i'm sure aaron knows for sure and that he'll pitch in shortly.

  • Thanks for your reply. I will just have to wait and see if I receive any subpoeana in the mail. I went on a few web sites and they all state that if the truth is told, you can't be sued. But he has to disprove that its the truth. Thank you. Regards, Mandy
