Medical Ins. on auto Policy (Accidents & Personal Injury Law)

Wed, 08 Mar 2006 10:05:00 GMT

What is the name of your state? PA
i am getting insurance quotes, and comparing them to what i have.
I have Bodily injury, property damage - 100/300/100
i have uninsured & underinsured both - 100/300 unstacked
AND have 10 in medical
doesnt the bodily or uninsured or underinsured cover the medical depending who is at fault dont they cover all the options as far as medical?
Is the medical coverage on top of the other coverages a waste?
Thanks

According to my lawyer in an accident a few years ago, a "serious" injury means you have some kind of permanent disability from the accident, something that won't ever go away. But it is kind of a grey area, I still got some settlement money even though I didn't have any "permanent" disability and the accident happened in New Jersey.
You don't say where in PA you live, but don't get into an accident in New Jersey - there is no such thing as full tort in that state. At least that was the case in 2001, there may have been reforms since then.
I believe your policy should be full tort by default, you have to sign a release form to elect limited tort. I had to do this because I just couldn't afford my insurance with full tort, it was SIGNIFICANT savings and due to an accident I caused in 2003, my ins. is currently obscenely expensive. At any rate, even if you elect limited tort there are a few circumstances that full tort would be automatically granted - if you are a pedestrian hit by a car, if you are hit by a commercial vehicle, if you are hit by an out of state driver, and I think a few others.
As soon as I can afford it though, I'm switching back to full tort!

  • Well, in PA you're required to carry at least $5k in personal medical coverage. I don't think dropping from 10 to 5 is going to give you any significant savings. The nice thing about this medical coverage as opposed to health insurance is you can go to any doctor, no referrals, no copays, no percentages, they cover everything up until your coverage limit. Plus they cover things like chiropractors and massage therapy (with proper prescription) which are usually either not covered or very limited by health insurance.
The state minimums for liability are only 15K/30K, so you could drop that coverage down some...just keep in mind that if you cause an accident worth more then your coverage limits, YOU will be responsible for the rest. It's up to you if that's a risk you want to take.

  • The "Bodily injury, property damage - 100/300/100" is your liability coverage - this is what is used to pay OTHER PEOPLE if you cause an accident. This is NOT what pays their medical bills if you cause an accident that hurts them (see below), but it is what covers their claim for pain and suffering (if they make one) and to repair their car.
The 10 in medical payments is for YOU. PA is a no-fault state; meaning regardless of who caused the accident, each injured person's OWN insurance covers their medical payments. So if you are hurt in an auto accident, you have 10k for your medical bills. Not much if it is a serious accident, but keep in mind that so long as you have health insurance, that should pick up after the auto is exhausted.
I'm not *exactly* sure how UM/UIM coverage works but I believe if an accident is caused by someone with no insurance this coverage is used for your repairs and *possibly* your pain and suffering but I'm not sure.

In addition to ecmst12, UM/UIM coverage is very important. UM or Uninsured motorist coverage is for your pain and suffering, out of pocket medical bills, wage loss, etc.. when you are hit by an uninsured motorist. UIM or Underinsured motorist is for when you are hit by a motorist who does not have adequate coverage to pay your expenses and pain and suffering. UM/UIM has nothing to do with your property damage, that would be handled under collision and in PA there is no UMPD coverage (uninsured motorist property damage coverage).
Just remember that PA has a tort election on your policy. When you purchase your policy you can either choose "limited" or "full" tort. Limited tort will bar you from pain and suffering recovery versus the at-fault party unless you suffer a "serious" injury. Full tort allows full recovery of pain and suffering. So it usually is worthwhile to elect the full tort coverage, it might be cheaper to elect limited tort but when you get in that accident and injury your back or neck, you will wish you paid the few extra bucks and had full tort. Tort election also applies to UM and UIM claims. Just a suggestion.

  • Thanks for all the info, and it was kind of what i thought, BUT in my case.
    I have FUll Tort
I have the 100/300/100 for Bodily, Property & insured and underinsured Unstacked.
    Plus 10 Medical for myslef
    And good Health insurance.
So isant this all over kill... i know there is a good chance i could be in a bad accident, and yes i want everyone covered, but doesnt all this insurance like overlap, and basicly kind of a waste of money.?
should i cut back the medical on myself, since i have health insurance
    and what else?
    Does this make any sense?...lol
here is why i have a 2000 dodge Neon, i use for a work car, bought it used. My personal vehicle is a 2005 GMC 4 door truck. The insurance on the car is 900.00 a year, and my truck is 500.00 a year. and i have no claims or anything on my record ( knock on wood)... i am just trying to cut some on the insurance cost back a little.
