Responding to a Civil Summons (Additional Legal Subjects)

My question involves court procedures for the state of: California

Just to sum up my situation: My father owns a small business, and I work for him. A situation arose where a gentleman refused to leave my fathers business, and unfortunately i made the mistake of physically throwing him out of the store when he became unruly. So this gentleman has gone ahead and filed a lawsuit against me, and also one against my fathers business, and is asking for damages upwards of $100,000. I have a couple of questions for anybody that may know the answers. My father and I recieved the summons on March 26, 2009 and we have been given 30 days to respond. Saturday April 25, 2009 will be the 30th day. I know in some states if the expiration date falls on a weekend you are given to the following Monday. I am not sure if this is the case in the state of CA, and was wondering if anybody might know the answer to this. My fathers insurance is still reviewing the situation to determine wether or not they will defend us. So i would also like to know is there a way one could get an extension on the amount of time given to respond. I have looken through all the forms for civil cases in CA but can't seem to find one for this. My last question is when responding to this , must my father and I file seperate responses and pay seperate response fees, or is there a way we can just file one response for both myself and my fathers business. Thanks to anybody that can help.

  • Usually an insurance company will file an answer for you while it's reviewing the case, to make sure that you don't default. If you have not yet confirmed with the insurance company that they're filing an answer, do so first thing on Monday morning.

    You would normally get an extension of time to file an answer by agreement with the plaintiff.
