Almost a year ago, my son and I signed up for a fitness center memberships. I was asked to co-sign on my son's contract, I presumed, because my bank account was the source from which automatic monthly dues would be paid. He was 19 at the time we joined. We were told at the time that either one of us could come in and cancel the memberships "no questions asked" and they would honor our request, and "tear up the contract". We finally decided to do so, on November 8th, 2 5. I went in and signed cancellation forms. The manager signed them too. I have copies. But then the manager, who later said he was offended by my reason for cancellation, (I said it smelled bad, which it did), re-nigged by not authorizing the cancellation of my son's contract with his billing company, and demanded that my son come in to sign the form. My son does not want to do that because the manager has exhibited a violent temper and is a body builder. So the manager has instructed his billing company to keep billing my son for the contract, even though he signed the cancellation notice. I've had the bank drafts stopped because we were supposed to have not paid after Nov. 8th, 2 5. They already were able to extract two months membership fees automatically before I could stop the fund. I sent copies of the cancellation notice directly to the billing company. I don't want my son's credit affected over this. I feel as cosignor with full financial responsibility for the contract that I am entitled to have them honor their signed cancellation contract. Am I right?
