im a divorced dad with visitation as per a divorce decree in 1994. i had an amiable relationship with my ex and my son. i was in the army national guard. i was activated for the homland defense mission "operation noble eagle" for a year. during my deployment, my ex informed me that she wanted to get back together. she convinced me that she had changed her persecives, recognised her faults and pet peeves, and she promised to talk about her problems instead of saving them and blowing up over unrelated stuff. as i wanted a family more than anything, i agreed to reconsile. believing that she was sincere, when my contract in the army was up, i separated from service instead of reinlisting, citing my reasons as going to make a family. i moved in to her condo with her mom and our son. things were great for about 6 weeks then her drinking became a problem. she became verbally abusive to me without provocation. things continued to deteriorate untill she threw me out on the street for as yet an undefined reason. since then i have been living on the charity of friends and famliy, getting counsleing and medication for depression, my life is completley derailed. my treatment has compromised my ability to reinlist. they stopped taking my calls to my son. i just get the machine if that. i have been completely cut off from contact with my son. my father called them to see what he could do and he told me that they were trashing me to my son so they could say, "well he dosent want to talk to his dad".
i would like to sue my ex for the money i would have made on the duration of my deployment and damages. visitation, defamation of characher or anything else i can think of.
we were married and divorced in california, she now resides in nevada with my son. this reconciliation episode happened in nevada. can i sue her in california? what can i do about the "bad mouthing"? im sure her intent was to make me a homeless person. any other thoughts or options available to me?
any help would be greatly appreciated.

  • what about the money i lost leaving my job in the millitary. i was promised a family and i didnt get one. isnt it negligence that she went back on her word and as a result i lost money, the prospect of money in my profession of choice. isnt that damage?

    So would I. But neither you nor I can. You have suffered no damages.

    Yes, forget her and move on with your life. Aside from the visitation issues, you have no legal claim for anything.
    Since you were divorced in California then file a show cause for Contempt of court citing the failure to allow visitation contact. That's all you have a case for.

  • Shredder , If it's any consolation many men & fathers such as yourself have been well through the shredder ( no pun intended ).
    I am one of them.
    No you have no other claims, except to file visitation issues, and contempt if visits were order and are now not be allowed.
    Many employers will hire military veterans , over the gen. public.
    If you have any professional training from the military try and use it.
    Contact veterans offices on tips for employment , training and such.Contact a father's rights group for support and to learn your rights.
    The sooner you look beyond the X and focus on your future w/ visits w/ your child the sooner you'll get back on track. Try to pick yourself up. Start another relationship w/ one that likes you for you. Get visits and do things together .
