Tenant Falsely Accused of Trespassing (COURTS, LAWYERS & LITIGATION)

What is the name of your state? Virginia
Can I sue my ex-landlord? He is a multimillionaire who convinced the Arlington police I was trespassing in 1997, even though I had a valid lease. At the arrest, they did not allow me to show them my lease. It should have been obvious all my belongings and property were in the house. The landlord lied under oath many times to accuse me of "unlawful entry with the intent to destroy property."
I accepted an Alford Plea to put the issue to rest. The charge would be off my record, if I stayed away from the landlord for 2 years. But did not realize until later that it was a form of guilty plea. I would never knowingly plea guilty to something as ridiculous as unlawful entry in to my own home. My rent was paid up and all utilities were in my name.
To try to show a violation the Alford Plea, the landlord also accused me of assaulting him, and robbing his keys at gunpoint. I was found not guilty of assault by the jury. The landlord claimed he had to have all the locks changed on over 20 properties, but had no receipts. Even the prosecutor did not believe the gun story, and Nolle Prosequi'd the charge.
The landlord may be lying to arrest me in retaliation for my starting a Tenant Association, educating his tenants in their rights, and coaching them in the recovery of their security deposits in small claims court. He is misusing law enforcement for his personal gain, and costing me years of financial and emotional strain in court.

  • How did you obtain your personal items when you vacated the apartment?
    Did you physically pick the items up and were you arrested for trespass at that time also.
    The events you have posted are unbelievable.

  • Anyone can sue for anything, of course. I just wonder how much defense a multimillionaire can afford to hire.
    I did not have time to read all the information in the link, but the fact there was a fire made me wonder...was the property identified as being off limits or otherwise roped off and you entered the property anyway?
    Is there a current issue with your past landlord?

  • After the arrest, late at night, fingerprinting and processing, I was let go on personal recognizance the next morning. The Magistrate gave me a stay away order from the property pending the trial. I walked to my office, still in my pajamas, getting funny looks on the elevator.
    My secretary got my suit from my house, a few blocks away. With the help of friends, I eventually emptied the house in to a storage facility. I bought my own home, and moved my belongings there. I had enough of being a tenant.
    You are right that this sounds incredible - in the United States of America. I have petitioned Governor Warner and Arlington Representatives for a review of this matter.   • There was a fire back in May 1997, but I got the keys back from the Fire Marshall in June. The property was not roped off, but good point. The landlord tried to say the fire was still an issue. But on August 15 1997, the time of arrest, the kitchen fire had been repaired, and there were no restrictions on the property. I had all my stuff there, and was paying utilities. As another case, the landlord did not heed the warnings of his handy man Marvin about the electricity. After the fire, Pappas did not tell the Fire Marshall, and tried to cover up his liability and negligence. The man is a liar to authorities, and perhaps it is a criminal, not a civil matter, for Arlington Country to prosecute Pappas.
