Youth jails halt illegal holding of mentally ill
Action erases huge failure in juvenile justice system

New Jersey's youth jails have stopped the illegal warehousing of dozens of mentally
ill and neglected children, finally clearing up one of the juvenile justice system's
most notorious failures, officials said yesterday.
After missing a court-imposed June deadline, the state met a self-imposed Sept. 30
deadline by moving all but one of dozens of detainees who had been ordered by judges
into psychological treatment or a child-welfare placement, Child Advocate Kevin Ryan
said.
"This is hugely important for kids who have been languishing unlawfully behind bars
awaiting treatment," Ryan said. "It's critical that we never return to the days where
our juvenile jails become the mental health and child welfare placements for New
Jersey's poorest kids."
The achievement is a major step toward meeting the conditions of a 2003 federal
settlement in which the state agreed to overhaul its child welfare system, run by the
Division of Youth and Family Services. New Jersey's compliance with that settlement
is being monitored by a federal court-appointed panel of experts, whose chairman
welcomed yesterday's news.
"This really is something to be proud of," said Steven Cohen, a senior associate at
the Annie E. Casey Foundation in Baltimore. But, he said, if the system is truly
working correctly, the number of children waiting for mental health and child-welfare
placements will remain near zero.
"If they've done their job well enough, they ought to be able to sustain this. If
not, number will go back up," Cohen said.
Cohen's panel, however, is expected to release a report next week criticizing the
state's slow progress in meeting dozens of other deadlines to improve DYFS.
Juvenile detention centers are to be places of last resort for youths who have been
arrested and are at risk of harming people or ditching court. Critics say the centers
have been filled with kids who have nowhere else to go.
Some of them need therapy for mental illnesses and behavioral problems and belong in
residential treatment centers. Others have been neglected or abused, so they belong
in foster homes or group homes overseen by the child welfare system.
State officials acknowledged the warehousing problem in June 2003 when they agreed to
a series of reforms to settle a lawsuit filed by Children's Rights Inc. of New York.
Among the promised changes were removing from detention all children in need of
mental health or child-welfare placement and ensuring the warehousing was permanently
stopped
