husband violating probation (CRIMINAL LAW & PROCEDURE)

What is the name of your state? New York
husband on 3 year probation in one county for possession and dwi...is awaiting sentencing in another county for another possession charge which is most likely going to be another year of probation...the first county said that they will not make him visit (he's on mail in probation) nor visit the home due to no resources to cross county lines and that regular visits probably wont begin until second county sentences..question is..because of this..he is back to using so a drug test would definitely prove positive but no chance of being caught for a few months..is there a way to let the first county probation officer know this and charge him with a violation, or will they just not care at this point....?

  • because the system sucks....he was in jail for 60 days on the possession charged until he plead out to a A misdemeanor from a C felony...lovely...couldn't get an order of protection to keep him out of the house cause there were no threats of violence in the prior 45 days because he was incarcerated..couldnt keep him outta the house cause his name is on the deed...so i was then stuck..for the time being....now he starts using again and i will basically do anything to let them have him...as if he violates..all plea bets are off and the felony comes back...at least so they say...and that's why the loser is in the home..in a nutshell!....

  • ok, there's been some miscommunication somewhere...i haven't spoken to any DV spouses whatsoever...and i have never been undecisive..whether to help him or the prosecutor...i tried to have him put out but was told i couldn't....he has no history (at least with the law) of violence..and they would NOT issue an OP...then with him being an owner of the house...so the law helps who they want to, when they want to...and MY case was not "special" enough for them..

  • ahhh ... people often call the probation officers and rat out probationers.
    Suddenly, a probationer may be called in for a random test, even though it is not 'normal'.
    See how aggressive the Pro Off #1, who normally uses mail-in reporting may be, if they have reason to believe he's using. They may do something (or they may ignore...). Is it worth your 'dime' ? Call it in.

  • to be truthful....fear!....i'd feel alot safer, knowing how the system works now,..having him in jail....when you're dealing with a user...you never know what they are capable of...and i'm not willing to play and find out...i tried to do the consentual divorce and he was going for it..was prepared to sign..until his ex-con friends that he met at NA (which is another story inistself) started feeding his head full of garbage...whatever the fact.....i, his friends, family and attorney are just all waiting for him to be caught violating.....its inevitable**.OH BTW**....here's another question..when he ends up back in jail...do i have the right to leave the state with our children without his consent?
