What is the name of your state?New York
Imagine a case where a very stupid and **y 18-year-old was walking down the streets of Manhattan sipping from a beer in a brown paper bag. The cops pull up and demand to know what he/she is drinking and to see id. Due to sheer intimidation said 18-year-old yields to the cops wishes and presents a fake i.d. with a real name, but a false address and DOB. The cop writes up two summons papers. One for having an open alcohol container and the other for possession of alcohol by a minor with intent to consume. No mention of the fake i.d. (which let's say was confiscated), but the fake address is listed on the summons.
What would be the best course of acton for the aforementioned 18-year-old to take (in addition to showing up for court)?
What could one expect in terms of punishment for the above?

  • no but he should prepare his friend for the conseqences of his actions. he may not be the only one in trouble with the law. as i posted before, whoever gave him or sold him the beer can also face criminal charges.

  • he can pray-and also pray that whoever gave him the beer doesnt get arrested for giving alcohol to an underage person. the legal drinking age in ny is 21.the police can go after whoever gave him the beer. if he bought it at a store, the store could face heavy fines, and could have their license to sell alcohol permently revoked, and the cashier who sold it to him would most likely be fired. the bottom line is, whoever he got the beer from is in very serious trouble if the cops find them.

    would anyone be able to provide a step-by-step account of what will happen on court day? This person wants nothing more than to pay a fine (hopefully under $500) and maybe do some community work.

    Kelly, maybe you should stick to your usual routine. Did this guy ask about what would happen to the people who sold it?

    I have no idea how NY courts handle this, but they may have something comparable to how it would be handled in AL. Hire an attorney to represent you and to negotiate with the DA for the case to be placed on the Administrative Docket (or whatever the NY equivalent is) for 6 months, and to be dismissed at the end of the 6 months if you have completed XX hours of community service, paid the fine in full, and gotten no new charges.
