"Framed" Minor in Possession - Need Help (CRIMINAL LAW & PROCEDURE)

• I was not considered drinking at the time I told the officers I had 1-2 beers 2 or more hours ago at a friend's house. I even volunteered for a sobriety test, does this help me at all?

• I can't speak for judges, but I'm betting they've heard the argument "it wasn't mine, someone else put it there" so many times that you don't stand much of a chance of prevailing. In some states, the case can be made that having consumed alcohol by your own admission, you were in fact a minor in possession because it was in your blood stream.

  Let me reiterate what you said.
  You are a minor.
  You were drinking in public.
  The police showed up and you ran.
  Is all that correct so far?
  You are guilty. Doesn't even matter about the beer (not bear by the way) that was in your car. Based on the fact that you are a minor who was drinking in a parking lot you are guilty of minor in possession.
  As for your comment about public defenders -- well they don't suck as badly as having an idiot like you for a client. You are guilty. They can't make you innocent.

• Tsk Tsk OG... maybe there was a bear in his car and he was also charged with minor in possession of a wild animal. Depending on the type of bear, it could be in a protected class.
