What is the name of your state? Maine My boyfriend attended college in Florida and graduated the end of October. In about August/September (before he graduated) he got caugt with 2 fully grown pot plants, and about 3 baby ones. (In his and a friends apartment)The cops never took him to the station, and never pressed charges, in return they worked something out so he didn't get in bad trouble. My boyfriend finished what he had to do and left the state to come back home to Maine. He recently got pulled over, over Memorial weeked and got taken to jail for being a "fugitve" of the law. A search warrent was put out in Febuary, 4 months after he left and they never tired to contact anywhere, meaning in fla or Maine. Now hes being held in Maine waiting to hear form florida. HIs mom doesn't want to get a lawyer yet because he hasn't had the hearing yet and she wants to go, for now, with just a court appointed attorney. please help with any info about what will and could happen. thanks

  • Fact is until the warrant is taken care of properly then it will stand.
    Since Flordia will not extradite, he has been released, correct?
    Hire an attorney to take care of the issue, but don't count on that he will not have to go back to Florida to stand in front of the judge. (what was the actual charge?)

  • thank you **y attitude, if you must know he played rat to people he didn't really know and didn't care about to help himself. His roomate and him had the plants but only one of them got in trouble. The plants were moved from the roomates closet to my boyfriends becuz of height.The narcotics agents said if you sign this warrant we wont go in your roomates room (which there was more pot, not plants,just buds) so they told him he had to bust a few dealers, which he did. He payed over 30,000 to go to school for 14 months and was about to graduate so did what he had to do. Towards the end when it was time for him to leave to come back to Maine, after graduating, he contacted the narcotics agent who gave him a false name, and said ive got to head back to Maine can we finish this all, which they did. The warrant was put out in Febuary of 03 and he left begining of Nov. They had his contact info and never chose to contact him, so as you see this is a very unfair warrant charge. Any info preferably not sarcastic like the last. oh and ps florida said they will never extradite him they will only get him if he steps on florida soil.

  • Until the warrant is taken care of there is ALWAYS going to be the possiblity that he will be detained until it is determined if he will be extradited or indeed IS extradited. According to your original post "something was worked out, so he would not be in much trouble" looks like this is not true. Was what was worked out between your boyfriend and law enforcement or Prosecuting Attorney's or did your boyfriend decide to move away prior to his court date and this is what "working it out" consists of in this case?

  • I did put search warrant, i meant arrest warrent. Well the good news is when he went for his trial the state of Maine dissmissed the case, florida did not wish to extradite him, so what our new problem is, is that we want to move out of maine someday and lets say he gets pulled over again in lets say New York they could possibly arrest him and do the same thing over and over. Were tring to find out if the warrant is only for floirda, and what we can do to go about getting rid of it w/ out going to florida. I know we need a lawyer but dont have much money. Florida lawyer are like 5 grand and they say we cant have a lawyer from Maine. Anyone who cares got any info. thanks

  • There is no difference between a court-appointed attorney and "his own attorney"! A court-appointed attorney has a duty to defend him zealously, just as a private attorney would. The difference is who is paying. Often, court-appointed attorneys are as good as or better than private attorneys.

  • It wasn't a search warrant, it was an arrest warrant. And depending on how serious the charges he is facing, he could be sent back to Florida. This is why he should have his own attorney, not a court appointed attorney.

  • Its very weird, there was no charge, thats what makes this all so strange, and also a good case, but when i found his warrant charge from Orange County Florida online it said dangerous drugs, and it was for cultivation. They had two fully grown plants and 3 baby ones. But they never took him to the station, dealt with everything out of jail. It did not say online about the cultivation charges. His mother found out by calling florida, the weird thing is where his warrant info was online, it no longer registers, odd. Oh and yes he is out, spent 6 days in jail.
