CRIMINAL LAW & PROCEDURE: "Glass Violation" South Carolina Violation 8-1-211 (6)

My question involves criminal law for the state of: South Carolina, Beaufort County

I was issued a ticket this weekend for a "Glass Violation". I had a glass bottle on the beach.

I called the court this morning to get a fine amount etc.. and the person who answered the phone said she didnt have a copy of my ticket yet, but said I could fax it over to her and she would show the judge. She asked me if it had alcohol in it, and I said no, because it is just a "Glass Violation".

She went on and on saying that if there was alcohol in it, that the Judge will want to know. And will ask the cop who gave me the ticket.

She also said that the fine is typically $1092!!! And if there was alcohol in it, then thats a double whammy....

She freaked me out, so I did not fax her the ticket, I instead called an Attorney and sent it to him.

Im waiting to hear back from him, but in the meantime, I thought I would write in here.

Does anyone know what the fines are like for this?

And what do I do if I am asked if there was Alcohol???

This is crazy!! Im so stressed!!!!!!!!!!

This doesn't appear to be a statute - it's an ordinance violation? From what jurisdiction?

The court clerk should have a better sense of the fines than anybody here. Let's hope your lawyer works something out.

Thank you for getting back to me. I verifyed on the municipal court website and it does state that my fine is $1092. Crazy!

Im not sure what kind of a violation this is...

the 5th amendment essentially says you have the right to not incriminate yourself..... so if asked if the glass had alcohol in it you don't have to answer..... its the burden of the state to prove there was alcohol in it

and talk to your attorney about ways to reduce the fine is possible

but in my opinion that fine is absolutely ridiculous... but i'm not a state legislator or a judge so yeaaaa

UPDATE!

Fine was $1092.....Attorney got it reduced to $262. Whew....
Lesson learned!!!!
