"I hate him. He'll be fired within the month" (Employment & Labor Law)

My husband and I are both customer rep's for a credit card company in Alabama. His supervisor has recently been trying to get him fired because she does not like him.. basically she was hired by a stroke of luck and has no idea how to do her job, and was "put into her place" when she tried to make my husband do things he knew he'd get written up for. In team meetings she would walk around the room pointing out the people she liked and disliked "i like you, i don't like you, i *hate* you". And now she's telling people around the workplace that my husband WILL be fired by the end of the month. She's been writing him up for any and every thing she can legally get away with, and he's almost gone.

Is this a case of job discrimination? She has every right to write him up, although they are minute reasons that no other supervisor would care about. But she has told him she hated him, and several people have told him she was trying to get him fired, that just doesn't seem legal!

  • It's unprofessional, poor management, and a lot of other things, but unless your husband is being singled out this way SOLELY because of a protected characteristic, such as age, gender, race, national origin, etc., or because he reported a violation of law to the proper outside authorities, it is not ILLEGAL discrimination.

    This manager, it seems, is going to cause a high turnover in the long run in the department, but her actions are not inherently illegal. However, it would be perfectly appropriate for the employees to report her unprofessional actions to Human Resources. Maybe they don't know what's going on.
