"It seems we've made an error..." Any advice? Kentucky (Employment & Labor Law)

I've been on my new job for over 30 days. I was recently told that an error was made on my offer letter. They say I was given the "old letter" that isn't in line with their new policy. They said they were embarrassed and apologized for using "the wrong template."

Problem is I took a lower wage than I originally shot for because of the perks brought up verbally in the interview and in the offer letter which both managers and myself all signed together. Now those have been removed but I'm still at the lower wage. Instead of my health benefits kicking in in 90 days - it'll be 6 months: "as a result of the economy," a lot of my personal and sick hours and vacation time has been altered, etc. etc.

Is this legal? What happens if I don't sign it? I took the lower hourly wage because I needed the insurance (which is great) I had originally told them I wasn't interested in going below a certain wage - they asked me to go lower - but consider all of the perks. I did weigh them out and it wasn't a huge cut.
Now it is since 3 of them have been removed and one of them now doesn't kick in for months.

Any advice would be great since I'm expected "to sign on Monday."

  • Other than this and that I feel a bit underpaid, I'm really satisfied with the job. I like my co-workers and I have good hours.
    So I guess it boils down to how big a racket one wishes to make.

    I think it's crappy and unfair. I'm not sure what I'll do. Supposedly the administrator, the office manager, and myself are going to be having a small meeting about it "to work something out we're all happy with..."

    We'll see.

  • Very few offer letters rise to the level of an enforceable contract, and you'd need to have yours reviewed by a local attorney to determine whether yours do. You might also consult with the attorney as to whether you have a claim for "detrimental reliance" with regard to the original offer.

  • Since you are happy with the job, you want to limit the waves that you make, but it is still fair to at the very least, pick up a few bargaining chips in the discussions that may help you in the future.

    Politely make all of the points that you have stated; that you accepted the lower salary because of the perks and that those perks were and are important to you. Tell them that you like them personally and you like the job, so you would not consider leaving the company over this, but if there is anything at all that they can do to ease the impact on you, you would truly appreciate it. Maybe they'll throw you a bone of some kind, like a small salary adjustment, but most likely not. If they are human, though, this should give you a mental bargaining chip. They know they were wrong and you were bigger than the situation in being willing to work with them on it.

    And one more thing, they are thinking about this meeting too, so don't start talking at the beginning of the meeting; let them speak first. They may be willing to offer more than you and I are currently assuming.
