do i have to tell what type of surgery i am getting (Employment & Labor Law)

What is the name of your state? FL
I am having elective cosmetic surgery. I want to take a week and a half off sick leave for recovery. My employer requires a Doctor's note to do so, which shouldn't be a problem with my Dr. But my question is, Do I have to tell them what type of surgery I am having, or any kind of details to that effect? I'm paying for this myself, insurance company won't be involved at all.

  • P.S. Plan B would be to use vacation to cover your time off in which case your employer won't care what you're doing with the time.

  • If you come in with double D's I think they will notice. Or if you come in and you went from 34 to 25 I think they will notice that too. And most likely if you left looking like Ricki Lake and come back as Ricky **, I'm ALMOST positive they will know what kind of surgery you had.

  • Even though your employer's insurance company won't be paying, you still need your employer to grant leave. If your employer is subject to the Family and Medical Leave Act and you are covered by that law, then your employer can request you to complete the leave certification form provided by the Department of Labor, which includes specifics for your doctor to complete regarding a diagnosis and the type of surgery you're having. Your employer needs that information to determine whether this is a "serious health condition" and whether they have to grant leave (cosmetic surgery does qualify unless it's something minor.)
    Yes, your employer may insist upon knowing the type of surgery you're having. You can always tell them you'd prefer to keep it personal though and see if they'll go for it.
