Where I work, we are on annual contracts which are renewed each year. They've told several of us that when our contracts expire in a few months, that we'll be out of a job. Our positions are being eliminated due to financial reasons.

A couple of weeks after telling us that we were being laid off, they revised the company policy on vacation pay after termination. It had previously stated that upon termination, the employee could get paid for up to 10 vacation days. This new policy, which materialized after everyone had been put on notice, now says that we can only get paid for a maximum of 5 vacation days.

Is it legal to change the policy like this in order to not have to pay all of us for our vacation time?

  • It is legal, unless your contract specifically addressed the issue.

    Alabama law does not unconditionally require payment of accrued vacation at termination.

  • The reason I was confused was because policy specifically stated that they'd pay us for 10 days. Then they told us we were being laid off. Then they went and changed the policy so that we would only get 5. They changed the policy after we were notified of our layoff.

    Since Alabama law doesn't require them to pay us at all for these hours, can they change their own policy at any time like that?
