overtime pay (Employment & Labor Law)

New Jersey. The former company that i worked for refused to pay me ovetime wages although they have taken taxes out my check. When I complained he told me that I should quit and that by law he is nor required to pay me any overtime pay. What are my options and can i attain those monies owed by my former employee

  • Off the top of my head, that sounds like a nonexempt position to me. Contact the NJ Dept. of Labor and file a claim for unpaid overtime.

    My job duties were to sometime open and close kiosk location and sell wireless phones and accessories. I assisted existing and potential consumers with wireless needs. I cleaned location, assisted in mangerial work.

  • Then my answer stands. The only question is if, for the older time frames, the statute of limitations for filing a claim with the state DOL has passed.
    You should really have done this sooner.
