Quit Or Fired (Employment & Labor Law)

What is the name of your state? Washington
I work for a company that is in the process of going downhill, business wise, and as they began to crunch down on employees I wonder what I should do in case I am looking at getting fired, which could be very possible, they are nitpicking now to get rid of "excess" associates, now if you quit a job you cant collect unemployment right? but if you get fired or layed off you can, but quitting looks better on a resume than getting fired. what should I do?

  • I don't know what company 'Spiegel' is, but one IMPORTANT peice of advice - don't write any comments ANYWHERE that could be constured as defamation or libel. Chances are they can't connect them to you through your screen name, but some companies can be downright crafty and cruel! Apparently you can even be sued for groundless defamation - which can suck a lot of money out of a person!
    And I agree that quitting only looks better if you do have another job lined up already. It does sound like they are looking to fire people for 'performance reasons,' however petty the faults might actually be.
    In this case, it might be to your advantage to speak to your employer at any hypothetical termination meeting and tell them you understand that they are downsizing and would appreciate it if they would refer to your termination for that reason rather than for incompetence.
    You might even be able to get a decent reference from some member of management if you are reasonable - remember that firing is difficult for any but the most cold hearted (even when necessary) and they expect hostility in return. Give them something else, and maybe you can get something else from them in return.

  • You are correct - if you resign, you cannot collect unemployment.
    That aside, your job search will probably go better if you don't quit this job but rather start looking for another position immediately and ideally, resign the position you have when you accept another offer. In an interview, it's always easier to answer the question, "Why are you looking for a new job?" by answering that your organization is downsizing and you feel your position may be eliminated or that you are looking for advancement and a new opportunity than it is to answer the question "Why did you quit when you didn't have another job lined up?" I really can't think of any answer I've received to that question in an interview that didn't make me wonder if I was getting the whole story (most of the time, information obtained through obtaining references proved that I wasn't.)
    By the way, quitting doesn't look better on a resume than getting fired, although it all depends why the person was fired. Certainly being fired because a company has to cut-back on staff is perfectly understandable and unfortunately has become commonplace over the last several years. You should do everything within your power to avoid being fired for poor job performance which means performing your present job to the very best of your ability.
