Speaking of...Final Paycheck Penalties (Employment & Labor Law)

What is the name of your state? Florida
My former employer deducted $91.00 from my final paycheck for money they think I took from the cash box. It is listed under "Misc" on the paystub. Attached to the stub is a post-it note stating what the deduction is for.
Can they legally deduct the $91 without proof that I took it?

  • In most, but not quite all, states, employers cannot make ANY deductions from an employee's paycheck without their written consent, barring any deductions that are required by law and, in some cases, that are for the employee's benefits (health insurance, etc.).
    My source does not show any limitations on private employers in the state of Florida; however under the circumstances you describe, I think it's highly questionable. By all means check with the Department of Workforce Innovation (or whoever you guys have acting as your DOL these days) and see what they say. In any case, they would be the ones with whom you would file a complaint.
