Wrongfully Terminated Laws in Virginia (Employment & Labor Law)

I work for a for profit college in Virginia as an Admissions Representative. In for profit education they consider a Admissions Representative a Sales Representative. We are required to meet recruitment goals at the end of each term. It is never told formally or in the job description that you will be terminated if you miss your recruitment goals three terms in a row, however that is know in the industry that it will happen.

In my case I have been working with this school for 9 months and this month our director met with each rep individually to talk about performance on a monthly basis and said that if we miss three application goals in a row, we would be terminated. Now this rule is completely different from the rule of making your recruitment goals every 10 weeks. Recruitment goals are each applicant that actually starts school. Application goals are just getting a minimum of 8 applications put in a month. Now I know companies are initialed to change rules as they go along. But my question is can they make the rules retroactive for month before the rules were made.

For example going back month before the rules were made. And penalize the Representative for months that the rule was not in place.

  • We arent given 2 month to correct it, we were told Yesterday march 8th that we were going to be basing performance off the months rather then the class start or budget and they are counting Jan, and Feb. ( so that means the 3 months would be Jan., Feb. , and March) before anyone knew of the new rule. It is very possible especially for me to reach my Recruitment goal for each class and not meet the application goal. Because I have a high closing rate 70-80% so I can still make the budget as I did in the last term but not average 8 applications a month.

  • And as you are still being given two months to rectify the situation, it isn't even particularly unfair. Essentially your were being told that your performance the prior month was not acceptable and that you have two more months in which to bring it up to acceptable. There is nothing wrong with that.
