I am working in a supervisory position with a salary wage. I was told if icame to work as a supervisor and ifwhen I arrived I was needed to work as a regular staff member I would be paid my salary plus an hourly wage some what comprable to time and one half. almost every dayI work I am working as the on site on call supervisor and as regular staff. I am working 78 to 86 hours weekly. my employer has now decided they will only pay my salary wage and 30 hours of over time per pay period (bi- weekly). I am un able to regulate my overtime hours . because I am obligated as a supervisor to fill any positions not covered due to lack of staff or un reliable staff. Is it legal for my employer not to pay me for forsed over time?

  • If you are correctly classified as *exempt* under FLSA. There are no circumstances that you'd be entitled to overtime pay. Salary and hourly are just pay methods. They do not determine your eligibility for overtime. Your "primary" job duties do.

    The problem arises when you are doing both exempt and non-exempt duties. If you are spending a majority of your time on the non-exempt duties, your FLSA classification might need to be altered.

    If you are unsure of your classification, you may contact DOL and request a determination.
