Yet another discrimination question (Employment & Labor Law)

Wed, 18 Aug 2004 21:18:00 GMT

What is the name of your state? Wi
Hello, just signed up, nice to have an outlet.
I'll try to make this short and to the point.
I was Hired about a year ago at the same time as another white person, I am Mexican-American.
The other guy continues to work day after day and I have been laid off for about 6 months out of the year.
I was able to collect unemployment and still am.
My boss calls me and says "You need to go to **(another state) to work for 2-3 weeks or you will be fired."
Here I have been laid off not presently working with them on a full time or even part time basis.
We are talking quite a few states over, very far from my original Home that I presently live in.
I go and work, it ended up to be a month I worked in this other State.
I come back, they have me work awhile, laid off again.
Tell me to go back to this same State work out there again.
I travel again and work.
This time they did not give myself and 3 co-workers enough money for motel, meals etc.
We end up sleeping in tents on the worksite.
We would have had enough money for the motel but not enough for food, so the supervisor of the job decided to camp at the worksite.
I did not know I had to bring a tent, sleeping bag, flashlight etc to this other state.
I know this sounds ridiculous and made up, but it is not, it is the honest to god's truth.
What do you think about this?
I know I said short and to the point, but once you get going you cannot stop.
Thanks much.

  • Thanks A lot for the quick response and help.
I think this is a real benefit to be able to ask questions here.
    I really appreciate it.
    Have a good day!

  • I think that you have not provided any evidence to say that this happened BECAUSE OF your race. The fact that you are Hispanic and another employee is not, does not automatically mean that this was racially motivated. You say there were three other co-workers on the site with you; what race(s) were they?

  • The other two employees were both white.
I think your point was made.
I do not want to drag this on for you, but just to let you know we get back to Wi and they continue to work and I get laid off again.
    Thanks much.

  • Unless there's a skill issue (they have some skills you don't) or there's a seniority issue (they have more seniority - even if only a day), then I agree the situation is suspect. You may wish to file a discrimination complaint with the State. To do so, you should contact the Department of Workforce Development 608-266-6860. That's Madison. If you're in the Milwaukee area, then call 414-227-4384.
I also suggest you start looking for a new job. I don't know what type of work you do but I can tell you the manufacturing sector in Wisconsin has rebounded strongly since the first of the year and many employers are advertising open positions at all levels - from entry level to highly skilled.
There's no reason that you should continue working a job where you have to put up with the working conditions you describe. Good luck.

  • The additional information you have provided helps.
With that info, I agree that you have reason to be suspicious. As welll as the information Beth provided, you can also contact the EEOC since racial discrimination is also prohibited at the Federal level. I don't have their phone number handy but you can find additional information about filing a claim on their web site, www.eeoc.gov.
