:confused: You owe me that much .....was the last thing my former employer said to me as my almost four year job came to an end .I had $1920.00 gross pay due at the time of termination(which is being Argued also) This man , took the time out to print me ,Not one, but two checks for $0.00 .Not,knowing if I was right or wrong stated that it was against the law for him to do that .I base that Idea on the fact that I had been paying him $100.00 a month for well over a year and found out just recently that money that I was paying out of my check for insurance .(that I cancelled almost a year ago)was also being kept as repayment in the ($81.00 a month)When I brought this to his attention he said he would fix it .He did,On my next check it was removed and replaced with an additional $50.00 payroll advance repayment .bringing my total repayment to $200.00 a month.Without my agreement to make that size payments.I have never been able to audit the aledged amount that I owe ,I truely believe was and is far less than he claims.What is my recourse .What I right in the belief that what he did is illegal.Not even the IRS takes your whole check. Please help me !!!thru this confussion.I need your help. Thanks in advance for any advice . Gadget

  • His actions are illegal for several reasons:

    1) He cannot lower your pay down to zero, You must make a rate equal or greater to minimum wage.
    2) California requires that deductions have the approval of the employee, are authorized by state or federal law, for benefits such as medical OR pursuant to a CBA. His refusal to pay in one lump sum may be viewed as a deduction from your pay.

    You can file a wage claim with the state Division of Labor Standards Enforcement for the money that is owed to you.
