What is the name of your state? Michigan
My son is eighteen and a senior in high school. He works for mcdonalds and was told even though he is eighteen, because he is still in school his boss can only give him twenty five hours a week. I thought once you were eighteen child labor laws didn't apply to you. Is she right? Thank you.

  • Chloe, I edited my reply to include the link I referenced. Despite Jetx' claim, what the law proves is that there is no prohibition against an employer from working an 18-year-old whatever hours they agree to (i.e., no maximum hours, as for those under 18).

    No.... but what difference does it make? The employer can schedule how many, or how few, hours an employee can have. If the manager only wants to give him XX hours per week, his options are to work them or find another job with more hours.

    Finally, let me try to make this very clear. The manager is wrong in his/her statement as to the law. But that means absolutely NOTHING. The manager can schedule as few hours as the employee will accept. And if the employee doesn't like it, the employees ONLY recourse is to either work them or quit.
    What the hell will you gain if you confront the manager with the 'knowledge' gained from this forum? If I were that manager, the only thing you would gain would be to see your son full-time as he wouldn't be working for me anymore. You are talking about McDonalds.... not a real 'highly skilled' job anyway.

    Whether she knows the law or not is not relevant. If she wants to give him only 5 hours a week and say it is because of his age.... there is nothing wrong with it. If your intent is to just 'prove' that she is ignorant of the law, you might just find your son with LOTS of hours at home.
    Simply, there is NO reason that this is an issue..... except your own.

  • Thanks pattytx. That is what we thought. It could be though a policy of mcdonalds and not really a law. I was just thinking about that. It is hard to work and go to school at the same time. I am thinking his boss just has his best interest at heart. Which is hard to get through an eighteen year olds head. He likes that money coming in. I don't think Jetx understands or even cares where I am coming from as far as asking the question on my son's behalf. I really don't have a clue as to why he even answered me. Maybe he just doesn't like woman or he hates cats. I don't know. . I try to make it a practice to let my children once they are grown make their own choices. He asked for my advice and since I am not a lawyer I didn't know for sure. I didn't want to answer him without first making sure i was correct.
