Are we going to loose him? (Family Law)

Oregon- My husband has joint legal, shared physical custody of his now 5 yr old son. We filed custody of ex girlfriend in dec. 99. We have had an agreed upon "mediation" agreement that has been used since June 00. No judge has signed the agreement due to a few matters that the exgirlfriend was not following through on which were "court ordered". We have not had an attorney through this entire thing. Finally had court on Jan. 9. Exgirlfriend asked to go back to mediation to settle the childs school living arrangement. Judge reluctantly agreed. We have boy 4.9 days week, her 2.2. Her days are in middle of week however.
Mediation section did not go well. Hubby offered his ex for us to have him mon-fri her pick up friday after school, kindergarten so only going 1/2 day and we pick up that monday before school. She not agree. She want mon-fri. She said "I gave you everything in the first mediation section, I'm not giving you #$@lawknowledge.org.# now". She only cared about cs in first mediation section so she agreed to anything and everything. Later she found out she screwed herself.
Exgirlfriend has abusive boyfriend. She is 21 going on her 3rd child. No job, bad legal history (kidnapping,etc.). She never completed the 10th grade. We have called police about abuse but no charges. Put child in preschool 2 yrs ago, she pulled out "his dad won't ride the bus with him", is what she told the school. We had the teacher write us a letter as to the fact that she pulled him out of school for this.
So now we have to go to court. Have no way to pay for attorney, hubby just got laid off and is starting a new job that pays less. What is the likely hood that the judge will grant her mon-fri? We live 25 miles away. We are willing to drive him to school in the town she lives in if we have to but she won't agree. Is there any attorneys known that do probono?

  • We did file for custody in Dec 99. They had an agreement in mediation and that is what is getting taken care of. But now there are all the new issues that we are having to deal with and we don't know what to do or how to handle it.
