When is Child Support legally considered late (Family Law)

My California child support order says that payment is due on the 1st of every month. Is it considered "late" from the 2nd on, subject to 10 percent late fee from that date? Or is it only officially late after 30 days has passed? My ex-husband seems to think it's only after 30 days, so he pays his support check on the 30th of every month, so he's just about a month late most months.

  • In Massachusetts, late isn't late.
    The way the dept of revenue handles child support, is nothing short of silly.
    In a nutshell, they disperse the payment, the month after they receive it. ( or something similar)
    I pay bi weekly. I can miss a payment, and make up for it when my next payment is due, and technically, I wont be late ( but the mom won't get a payment that week)
    I can only imagine, that my state isn't the only one who does it like this.
    Let your ex think he's getting away with something, that he actually isn't.
    If you're getting a payment every 30 days, there's nothing that can be done really.
    All that means is, when child support ends, he will have to pay an extra payment ( that he wouldn't have to pay if he was on time)

  • Late is late. He's probably anticipating that the courts aren't going to be very interested in assisting with the collection of support that's less than a month late.
