Cohabiting after being seperated 18 months (Family Law)

Wed, 25 Jul 2001 10:38:00 GMT

I am in Virginia. My fiance and I began dating 8 months ago. At the time she told me that she wasn't married and didn't have children but I since learned that she has been legally seperated 18 months and been trying to get a divorce without knowing the procedures (she is a resident alien from the Philippines where divorce is not normally allowed).
She married eight or nine years ago but left after three months after finding out what kind of person her spouse was. Eventually he went and got her and brought her home and they had a son 5 years ago but have not had maritial relations since. She has offered the spouse nearly all of the maritial assets and joint custody and yet he is still contesting.
She supported him throughout most of their marriage since he owed $30k in back child support and couldn't hold a job without having payments garnished. Since the seperation though he has been using a second social security number to avoid having the payments garnished and has thus been able to support himself although she did pay for his car and insurance and he lives with his mother so doesn't have that expense. Two years ago she was forced to file bankrupsy because of his spending.
The ex-husband and his mother have been using the son as a hostage to keep her in the country and supporting him. In the time that we have been dating she has confided that she was at the point of leaving the country and abandoning her son if that is what it takes to get away from this man.
Her ex is 55 years old and his mother is now dying and leaving everything to his son as it would otherwise go to pay his back child support payments but he is evidently using it to hire lawyers to fight the divorce as he doesn't want it.
My fiance's car has given out and she needed to buy a new one but to make the payments she can't maintain a seperate residence so she needs to move in with me. Will this hurt her chances of getting a divorce in Virginia?
