Mother wrongfully claiming deduction for our child after divorce (Government & Administrative Law)

hello my stepdaughters mother is always claiming her on her tax return when shes not supposed to. Her ex-husband and i were married. On their legal aggreement after they divorce that they have the rights to claim the child every other year like my husband can claim her evry odd year and she can claim her every even year but this is always an issue coz she always claim her on my husbands turn too. we always ended filing the legal papers which is a big hustle coz they have to review it and prove that it was my husbands turn and they send the refund later after 2 months. i want to ask if we can do something to avoid dealing with this every time. And also is their anyway you think she have her refund and owe the irs for claiming their daughter when she's not supposed to.

  • You can't stop her; but you can try to raise the stakes, for example by raising the issue before the court which entered the order for alternating the deduction, and requesting appropriate relief.

  • On the years that your husband is supposed to claim his child, file EARLY. . .the day he has his W-2, file. . . then if she tries to claim the same dependent, she can explain it to the IRS herself.
