CIC <-> HRDC Question Exprerts please (longish) (Immigration Law)

This question is for experts or former CIC officers. I'm a Ukrainian
citizen, graduated from a Canadian university. Right after school I got a
job offer from a company that my relatives own in Canada (offer is
legitimate, I actually work there, pay taxes etc) With this offer I got an
EO8 permit (without HRDC confirmation). After a year, when E08 permit has
expired, I got another offer from them, to continue my employment. I got
refused due to the fact that my salary, according to HRDC, was too low for
the position I held (CAD40000). After hiring a consultant, re-aplied and got
approved after HRDC's request that my salary should be raised to CAD70000. I
got a letter from the company confirming that they will pay CAD70000. In
HRDC approval there is no such formal condition, I would imageine it is
somewhere in my HRDC file though. As a metter of fact the letter has no
conditions. Now I'm getting all the documents together to apply for PR.
HOWEVER my salary is still 40000 and situation in the company does not
permit to pay me (I know that first hand) 70000. The questions that bother
me are:
1) can I apply specifying that my salary is 40000, would this affect me in
any way?
2) is there any mechanism in CIC to determine that the raise was requested
and confirmed by the company, if this does not appear in the approval
letter.

Please note that there was no intent to defraud CIC or HRDC. The job is 100%
legit, I actually work there, have my office, get pay checks, have benefits
etc.
