DMV SUCK (Immigration Law)

Sorry but I tried posting in the new NG link given to me by Meauxna
and I was not able to which is why I am posting a brand new post her.

Thanks to all who replied, Marnee thank you as well. Meauxna is right,
I do not have an EAD. I am a permanent resident. My current green card
(conditional) has experied on 12/25/03 and the extension notice given
to the DMV was not sufficient. What worries me sick is that I have not
yet heard from the soto office as to wether or not my case has been
adjudicated. What is taking so long in the first place ? I sooo wish
to be called in with my husband for an interview, they could question
us separately as long as they desired because we are a real couple and
have a daughter together, we have nothing to hide. I just want to get
my 10 years green card.

The questions is this and I wonder if someone on this ng can provide
me with an answer, can I still get an I-551 stamp now or is it just to
late? In other words will INS issue me an I-551 stamp now up to
12/25/04 ??. My second question is if I wanted to travel outside of
the states now, will they issue me an I-551 stamp? And lastly what
should I do if INS does not approve my I-751 petition by 12/25/04 ?
Cleary, my card has expired, I have no I-551 stamp in my passport and
that receipt notice from my INS does not do me any good since DMV
thinks that I am no longer a permanent resident. I am soo frustrated
at this stage, I really should have gotten my I-551 stamp and now I
can't even get my driver's license.

  • Hi, I am back I finally went to INS in L.A via info pass. right after thanksgiving (black friday) the line was SHORT. I waited in line for about 10 minutes once inside the building, I enquired as to why my I-751 had not been adjudicated yet. I filed it just on time on 12/22/03 right before 12/25/03 ( the deadline) however when I filed it I had forgotten to sign the check. Ofcourse I did not know this until sometime in january when the INS returned the package to me with the check and instructed to resubmitt, also in the pakage included the receit notice showing 12/23/03 WHICH DOES proove INS (laguna nigel) received it on time, but the catch is this: they did not processed it in their system. Soo, when I resubmiited my package in february with the signed check, INS mailed me ANOTHER receit notice showing a date of february 8,03 which is the date I had mailed it to them. The officer told me that this was the reason why it had been transfered to the soto office and that technically I filed late. I asked him if that would jepordize my stay, he did not think I should worry, because I had the INITIAL receipt notice showing I MAILED the application timely but told me that it could be a problem but not to worry. Ok so basically the reason why my application was not adjudicated was because sinde INS processed my application in February 03, they have until february 04 to render their decision and call me in at which point the officer explain that I will be given the opportunity to explain the adjudicating officer on soto street what had happened. He also told me to make sure to bring my first initial Receipt notice shwoing 12/23/03 to adjudicating officer and explain to him that it was an honest mistake. I am sort of worry but I do not want to overeact with this, but again I can't help it , I am very settled here and can't imagibe being removed from my family. I would like to know what we should do if the adjudicating officer were to be hearless and denied my petition. I just want to prepare for the worst just in case. We just want to move on with our lives and if something bad were to happen, we will fight it and retain an attorney whatever it takes. On a lighter note I did get my I-551 STAMP that means that I can finally take my driver's test ! Yippee !

    In order to post in BE, you need to register (pick a username and
    password). It's pretty seamless.

    You have received good advice here.

    I sense a bit of panic in your words.

    Your I-551 status is automatically extended until you have your I-751
    adjudicated. The date that the first NOA extended your I-551 card until
    is meaningless. The status is extended indefinitely until you have your
    I-751 adjudicated. So, 12/25/04 is not a drop-dead date by any means.
    Some would even argue it is a day to celebrate (ho, ho, ho). As others
    have said, make an Infopass and get your stamp. Most offices will issue
    you a stamp for a year (from the day you walk in).

    However, for all practical purposes, you don't need the stamp unless you
    need to prove your status to a non-USCIS entity like DMV, an employer,
    or the airlines. In this case, DMV is all screwed up so you will have to
    get the stamp to make them happy. Otherwise, you wouldn't even need to
    get a stamp.

    As a side note, I see that CSC is currently processing I-751s with a
    receipt date of May 19, 2004. Seing as how you submitted your I-751 in
    2003 you might want to make an inquiry about the hold up. And, by the
    way, most people filing I-751s get approved without interview (so don't
    necessarily assume you will be interviewed).

    I'm in LA -- you can get the stamp with no problem. Use InfoPass. Soto
    street has a backlog and they are working quite hard on it. But they do
    have a backlog.

    I agree, dont worry about it unless that time comes. If they were to
    deny it, then yes, get an attorney. Good Luck on your test!

    Thanks, I will need all the luck I need. I have been wanting to dry for
    a LONG TIME ! but nerve damage to the plantar of my sole (due to shor
    stay in army) prevented me from driving. I am now ok and the pain is all
    gone. So I am glad that I won't have to depend aon hubby to take me
    everwhere. I can finally go shopping on my owne.

    Thanks for the invaluable information. I have schedule an info Pass for
    this coming friday and was wondering how long the waiting line will be,
    I have seen on some other post that people have had to wait in the past
    even though they had an info pass scheduled at a set time. So should I
    come a few minutes before my scheduled time or a few hours anyway.

    The wait isn't that long in Los Angeles to get inside. The wait inside
    may be long though.

    BTW, I have a deferred inspection at CBP in the building and the
    InfoPass entrance is the attorney's entrance also.

    Ok, I would like to know what course of actions to take in the event the
    adjudicating officer on Soto Street in L.A. were to DENIED my petition.
    Again, I filed, timely few days Right before expiration date BUT still
    timely (got the RECEIPT notice from Laguna nigel) dated 12/23/03.
    Deadline was 12/25/03. Yeah I know, I barely MADE it. So to sum things
    up, when I received the notice I was SURPRISED to see the I-751
    application and PACKAGE I had intially submitted to them. Well the
    reason why they mailed it back to me was BECAUSE the check I initially
    included was not SIGNED. OH GREAT, so they NEVER actually processed my
    application in their computer, but I DID (thankfully get the receipt
    notice of 12/23/03 showing after all It was MAILED timely) Even though
    they NEVER processed it. So I resent the whole thing with the check
    (signed of course !) sometime in February 04, and 10 days later, I get
    another receipt notice showing the date I had resubmitted the petition.
    Well When I went to L.A. last week to enquire as to why they had not
    adjudicated my package, they told me that it had been transfered to Soto
    street, the window officer was surprise that I had 2 receipt notice and
    I explained to him why and how it got to be that way. He said the the
    FIRST receitt notice did not count since they NEVER PROCESSED the
    application because it was not considered to be complete due to the
    unsigned check. He further stated that the Second one showing the
    receipt date of 02-04 was the one that counted and therefore since we
    are not 02-05 (feb 05) had still had time to get called in Soto office
    he advised me to keep the first notice as proof that I filed timely even
    thought the application was never processed to begin with and to explain
    this to the adjudcating officer once I get called it for an interview,
    but what IF it DENIES ME anyway, wouldn't be removed, what course of
    actions will I have ? Can filing for AOS be ok, or should appeal the
    decision and have a BIA judge listens to my case, if it gets that far,
    what are the odds of me staying here with my family. I am nervous, this
    whole thing is stressin me out. Also in the event they were to remove
    ME from here (sucessfuly) I would be sent back to Paris (France) and how
    long will it take for me to re-file a family based petition and be re-
    admitted here ? or will be able to ?
