Two questions on DS-230 Part I (Immigration Law)

Sun, 11 Jul 2004 12:00:00 GMT

Hey guys...

I was and still am a little confused about question 21a of
form DS-210 Part I. :(

It asks the "person(s) named in 14 and 19 who
will accompany you to the United States now".

Well of course, #14 has
my (soon-to-be) spouse's name on it. Do I fill out his name in question
#21a or not? He is the USC and is not accompanying me to the States. I
mean... isn't question #21a (and 21b for that matter) meant for those
who are immigrating to the US too? But my spouse is USC and isn't even
accompanying me to the States since he will already be there again by
the time I move there.

About question #25... I went to the US on VWP...
So, do I fill "VWP" with Type of Visa or is there another name for the
Visa Waiver stuff?

Thanks... again.

  • Hi,

    @lawknowledge.org.21st,

Thank you. I was there on vacation, so I'll fill in VWP. I
thought so anyway, but I thought I'd just make sure by asking.

    @lawknowledge.org.half-
    pint

I am indeed getting married upcoming Friday, but because we will
do DCF the same day, I am already filling out the forms as if my fianc
is already my husband. So anyway... your husband will be accompanying
    you to the States...
Mine is not (he'll already be there) PLUS he is a
USC... I just can't get rid of the impression that the questions #21a
and 21b are meant for those who have non-USC spouse and children that
are immigrating to the US together with the applicant of the form...
    So
that's why I think it should be left blank, but I'm not sure...

    Anyone
here who can enlighten me? Thanks.

    Hey there
    Nortje:)

That question refers to non US citizens that will accompany
    you to the United States.
    Good Luck with the wedding!!

    Hi Noortje,

With regard to #25, the VWP may be used for three purposes - Business,
pleasure or transit. So you can enter the answer as VWP for pleasure.

    Cheers
    21st.

    Cheers 21st.

It says in her signature that she is
applying for DCF since she is marrying her fiance next week, therefore
when she actually files the forms he will be her husband? Therefore she
    will list him in #14?

    Hi!

    I put
my husbands name (US citizen) on #21a as he will be accompanying me. I
also put VWP down as type of visa. I haven't had it posted back so I am
    hoping it will be okay.

    Hope this helps.
