Yay we are married! Confusion on what to file next :/ Help! (Immigration Law)

Thu, 04 Mar 2004 21:11:00 GMT

Hello all! My British fiance is now my British Hubby :)) He arrived
Dec 29th and we were married Feb 7th. To those who are still waiting
on K-1s to come through- after you are together all that time apart
fades into a memory so keep looking up! :)
To those of you who have already gone through all this, we need some
help please.
What papers do we need to fill out next now that we are married? He
applied for his SSN when he first got here so he has banking etc set
up, he has not applied for his EAD yet though because I was thinking
he had to wait til after we were married. Am I correct that he will
need to apply for a new ssn after getting permission to work?
I think we file the I-485 adjustment of status and I use the I-864
afidavit of support and we should also file the I 765 EAD so he can
get a job one day! But I am not sure if we send them in together to
Texas Service center (We are in Ga) or to Atlanta or what- Or the
timeframe we have to file in :(
Basically I am clueless, the website is making my head spin, and I
cannot get anyone in the Customer relations (not service by any means
haha!) department to even answer the phone! Whenever I call they say
all reps are busy please call beack and hang up. I can't even get put
on hold! Arg!
ANY advice is appreciated! Thank you so much!

Janadeen has given you the URL for
the FAQ. Not only does it deal with the K-1 visa but also continues on
with what is required for filing for AOS. There is also a link for
filing experiences for various district offices throughout the US.
That, as well, might be helpful.

    Correct assumption
    Am I correct that
he will need to apply for a new ssn after getting permission to
    work?

Incorrect. The ss number will be his for life. After he
becomes a Permanent Resident he can ask to have the legend "work
authorized by INS" removed. But the number will remain the same.

The filings do NOT go to the
service center but to your local district office. For you, this
apparently is Atlanta. The only posters who must file a service center
are those people who live in the jurisdiction of the Baltimore, MD
    district office.

As for timeframes, either check out the USCIS page or
the AILA page or follow the link to Matt Udall's page listed in the FAQ.

If you think you are clueless, then rest assured that
the telepersonnel who answer the phones at the 1-800 misinformation
number have even less of a clue than you.

  • Ravy - most of the questions you asked can be answered here:

    I highly
recommend you read this - it is very clear - it'll help you for certain,
at least for a start. You need to do a lot more research. Best of
    luck! (-:

  • hi, ravy.
i dont see any reason why he has to apply another SSN. he
doesnt change his name, right? and i dont think he has to get new SSN to
    work.

Well after married, you will have to apply for adjustment of
status. And EAD, if you want him to work. as far as i know, the
adjustment of status file and EAD file is sent to your local office.

    have a nice day,
    anggraeni
