I live in Florida,
One year ago I began a long distance relationship with a Filipina working in Hong Kong as a maid. We wrote letters on a weekly basis, and talked almost every night. In late August I decided to go to Hong Kong to meet her. I spent three weeks with her, and decided that we would get married. I asked INS which was the quickest way to do this, and they suggested K-visa Fiance visa. I came back to the states and began the process. Here is the problem. In 1995 she lost her passport and obtained another passport NOT in her correct name. Her correct first name is Suzanna. Her new passport shows as Yanie which is the name she has gone by all of her life. So she is technically working in Hong Kong under an assumed name.
My petition for fiance visa was approved here in the states for "Yanie." The paper work was then forwarded to the U.S. Consulate in Hong Kong. She responded there with her passport, and they told her that she would need a valid birth certificate from the P.I. along with police clearances. They gave her a list of things she would need. No problem until we tried to get a birth certificate for Yanie. There aint one. Just the true B.C. for Susanna. Now what? She is afraid to ask U.S consulate what to do because of not using her correct name. Is there an ammendment I can file? Is there an affidavit she can sign? I need to know how to rectify the situation. I thought about just dropping the whole process for Yanie and let her go back to the P.I. and start all over again with correct name. This will take another 6 months or so. If I do this, the INS will know, because one of the questions on the petition is Have you ever filed a petition before? I really appreciate any advice that I can get. She is a good girl, and I was looking forward to spending the rest of my life with her. I apologize for this being so long.

  • Go through the whole process over in her correct name and wait out the possible 6 months, you really have no choice. Unless you want to move to Hong Kong and marry her there!
