Younger women - Will INS look harder? (Immigration Law)

Sun, 21 Dec 2003 08:53:00 GMT

There are simple ways to protect your current assets without a prenup.
Noone but you and your advisors need know about them. Go see a good
financial planner/attorney.

Thanks for the reply. I was just a little bit concerned about the age difference with
respect to the official world. As far as I am concerned it makes absolutely no difference.
(Thanks to the others that replied about their relationships).

I mentioned the pre-nup because I wanted to get a feel for how the Philippine culture
would take the idea of a pre-nup. I really don't know how to approach the subject because
to a large extent I don't like the idea of a pre-nup. I imagine that it will go over,
with her family, just about as well as the idea of not getting a pre- nup would go over
with my family.

The problems with a pre-nup, in my mind are that it is a preparation for failure (divorce)
and to a certain extent it says that you do not trust the other person. Having said that,
most if not all of my friends and family (that know my personal worth) say that I would be
an absolute fool for not setting up a pre-nup. As for the understanding of the pre-nup, I
plan to have it translated into Tagalog and to hire a lawyer for her so that he/she can
explain it to her.

What does the community think about pre-nups and maybe any suggestions on how to bring the
subject up. I still hate the idea.

I have two questions.

1. Will the INS be looking at my K-1 petition closer due to the fact that she is a
LITTLE bit younger than I am.

In Manila, YES. Also be prepared for her to provide a letter of permission from
her parents.

2. I am probably going to be setting up a pre-nupitial agreement to protest my current
assets (I don't really like the idea but everybody says that I would be a fool not
to). Will this be looked down on by the INS/consulate or is this something that they
just plain don't need to know about.

INS/DOS don't need to know, nor do they even care. You had, however, better be
ready to defend yourself from the bolo or balisong that the father is going to
take to your throat when he hears about your ideas for a prenup.

In the Philippines there is no divorce. Therefore, there is no need for a prenup
in their minds; and they will fight it hammer and tong (bolo/balisong).

FWIW, prenups require a separate lawyer for both parties and a complete
understanding of the conditions by both parties in order for it to hold up in
court. It's doubtful that any court would recognize that a 20 yr old from a 3rd
world country has a complete understanding of anything that she signs along
those lines. Good luck.

I really wish that I had known about the G325A when I was there last as it would have
saved the time that we are using to get the forms to her and for me to get them back to
that I can put the package together for the I-129F.

FedEx does 2-3 day service between the US and Manila.

Regards,

DUTCH
