yr OPINION please! foreign spouse birth certificate for AOS interview (Immigration Law)

hi everyone,

just received AOS interview letter, it came much faster than we
expected. interview will be in 4 weeks. question:

1. foreign spouse requested birth certificate to be mailed, but there
are no guarantees that it will arrive on time. what to do? the letter
does not mention bringing original birth certificate (spouse has a
certified and translated copy of it, which was submitted in AOS
packet); it just mentions "bring supporting documentation of
comingling finances" or something similar. will certified copy and
passport be enough?

2. ADIT photos are not mentioned in letter. should we bring 2 each, or
how many can they ask for? (we sent all requested ADIT photos in AOS
packet, but here many of you mentioned that interviewer can ask for
additional photos).

  • 1. Go with what you have. If you don't have it you don't have it. They
    may not even ask to see it.

    2. No additional photographs are needed.
    And if they are they can usually take them there.

    Kenneth,
    Concerning
    its arrival, you might ask a relative/friend in that country to obtain
    it for you and then express mail/fed ex it to you. A bit more
    expensive, but you're more assured about its arrival. I don't know your
    country's process, but maybe you can have the government office mail it
    locally to that relative/friend or maybe they can pick it up in person
    and then express ship it to you.

    Even though your AOS letter doesn't
    say to bring it, you need to decide if you'll be comfortable going to
    the AOS interview without the birth certificate. Granted if it doesn't
    say bring it then technically you're not at "fault" for not bringing it,
    but you may want to overlook that and bring it anyway so you'll be
    covered if they do ask for it, which apparently your leaning. (AOS
    interview is not about "you versus them" regarding a document list, it's
    about getting a succesful AOS outcome).

    Regarding the ADIT photos, as
    far as I know those are not needed at the AOS interview and I have not
    heard of an instance where they were required at the AOS interview, but
    that's me.

    thank you all for the advice! i hope they will consider the fact that
    the interview letter came so fast, we didn't have time to order
    everything from abroad.

    question: did anyone try getting b.c. certified copy from foreign
    country's embassy here in u.s.? spouse had her passport renewed a
    while back,and they asked for original, so they should still have the
    original.do embassies do that?

    well so far, we will bring certified copies of bc, passports,driver's
    licenses, any other ID that would be useful?
