state of michigan
received an eviction notice back in february, got everything paid in full. landlord and everybody agreed it was in error in their part. when on a vacation for 1 week in march, came back and everything i owned is gone. talked with the lady and the office and said they made a mistake. but now i have nothing. what help can anybody give me to get money for all my personal belongings and whatever. i had about $20,000 worth of stuff that all the neighbors took after the police threw it outside. no clothing for me & my son, no toys, nothing and he doesn't understand.

  • There was no court order to evict me and the police were not there to supervise the moving of my stuff...this happened 4 days after receiving a 7 day eviction notice. I did call the police and tell them what happened. They told me to get a lawyer.
    Someone replied by saying I could sue for a ton of money, exactly how much money are you talking about?
    We have witnesses that the landlords & management took our stuff. Someone told me I could receive up to $250.00 a day until I get this settled or whatever.
    Please help me. I do meet with a lawyer next week.

  • That is what I plan on doing...sue for everything....
    A woman in Florida got evicted this same way....she sued and got a quarter of a million dollars in damages.

  • Michigan I think the landlord was wrong in this matter and they should be sued to the fullest. They have nothing now but the clothes on their back. It is really sad and I hope they get alot of$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$$. Good luck cuz I think you have a good case. Just get everything together and hope it works out for you. The child is 4 and doesn't understand what happened to his toys and stuff. They could sue for mental to if they wanted to.

    You'd be lucky to get a few thousand with NO PROOF of any of the items value!
    So your Car was not running, and you not home for a few days...7 day notice to pay up or move
    Plus you are NOT MARRIED** he figured you split up.
    Now do you see his side of this, he had no clue if he would ever see a DIME from you!

    Did you respond to the court?....no..
    Did you have a court date? Yes
    Did you appear at the specified time? NO
    Were you legally evcited by a court? Like everyone else?.....
    Wellll**did you go to the courthouse and see if there was an actual warrant for your eviction?
    Now will you get renters insurance, And pay your rent on time, And learn how to read any court documents?
    Remember a judge hears BOTH sides of a case, if you were not there, all he has is the landlords side, that you owe money, and you LOSE!
    IF you can PROVE there was NO court date, and NO eviction order signed by a judge....
    THEN get a lawyer and sue for everything..

  • You had better go down to the courthouse and search your case, to make sure you were not evcited.
    Most all are computerized, so you type in your name and see if anything comes up....then type in the landlords name and see if the others were evicted, and on what date there trail was held.
    YOU will have to pay a laywers paralegal to do this work so save yourself some money....make absolutely sure you were NOT legally evicted in a court proceeding.
    If the landlords employees threw your stuff out without a marshall or sherriff standing there with signed court papers evicting you at your apartment number, then you would be entitled to a lot of damages. big $$$$$$$$$
    So contact the marshall or sheriff's office and see if they evicted you during that week, and ask to see the signed court order.
    Dont explain anything to them, this a pubilc records, they may ask to see your ID, but you have a right to see the court order.
    Thats why this is so important, you must do the legwork and piece together what actually happend.

  • just to let all of you know, the landlord sent out eviction notices to all the rental units, all but 2 were suppose to be out. we checked with the manager of the building, etc and we were the ones that were ok about living there. we don't have renters insurance. the landlord or manager said he would take care of the eviction notice and we were ok living there, we were paid in full. we went to nebraska for a week to visit relatives and came back & found nothing. the guy that works for the federal court system saids they should of held our property for 30 days unstead of tossing it out to the scavengers we live by.

    Did You READ the summons and complaint?
    Of course you did NOT!
    Did you see a laywer or ask questions?
    Did you resond to the court by the date in the summons? I guess not.
    Did anyone serve you papers for a court date?
    And you didnt show up?
    Well thats what happened.
    You didnt read the papers, and refused to find anyone who can read them. So you were found GUILTY in a court of law, and the judge issued a warrent to evict you , the marshall came and tossed your stuff out.
    All pretty legal....since you didnt follow the directions printed on the summons.
    And of course the landlord will not sign anything agreeing that it was a mistake... RIGHT?
    PS.. NOW does less then $200 a year for renters Insurance sound EXPENSIVE?

  • No the landlord said to disregard the eviction because it was not meant for me. He said everyhing was fine and not to worry about any of this....we never went to court of anything.
    According to the federal court system I have a case. I just wanted some advice from anyone who has gone thru this.

  • YOU may or MAYNOT have a case**
    The only question is:
    Were you Evicted and found GUILTY in a court of law and did the judge issue a legal Eviction order to the sherriff or marshall to toss your stuff out!
    Just because a landlord says dont worry about it
    THAT IS THE TIME TO WORRY ABOUT IT**.
    I still say you were legally evcited becuase you have no proof to say you wern't.
    IF there was NO court order and NO police to supervise the removal of your stuff THEN you could sue for a ton of money!
    YOU didnt read the papers that were given to you, and the landlord lied (but not in court) and YOU believed the landlord.
    I guess this is a very very expensive lesson in Life Skills...
    And i guess you will never never never ever pay your rent late again ....right?
