I'll try to explain this as brief as possible,
Hello, I am the middle child of 3 sons my mother raised .
growing up some what separated of one another,so the brotherly closeness is some what not all there with my older brother but we are on very good terms,my younger brother and I are very close and always have been I more or less raised him,with that said my concern is my Grandmothers estate/will,
IF and when she dies It is clear that we(the brothers) are to acquire the house and all things in it no one else, the home is all paid up no mortgage payment due,my younger brother plans to move in when she passes,I for one currently live with her of the last 10 years and have been taking care of her.(cooking,cleaning,home repair,etc) she is 89 years old and in poor health.grandma's wishes for my younger brother and to move in to this house and pay a 1/3 assessment of the total cost of the home to my Older brother witch he says this is fine. but it is not in the will.just the fact that the house is to be divided up between us.He is however the Executor of state only due to me living out of state at that time of a "in need for one",( I am however have the power of attorney for all her health care,also all the bills (phone,water,power)
Bottom line I am afraid that my older brother will contest to the buy out,due to him buying a home of his own this year ,getting married and having a child he may need the money .I am unclear about his finances ,I do know he makes "very good" money,thus my younger brother and I will be on the street more or less if he decides to sell.
1) Is there anything I can do to see that my Grandmother's wishes are followed through .
2) do I need a personal lawyer to "overview" the will
I do not understand how much power the "executor of state" has.
past history with family matters is not good witch brings me here for your help,

    You have a good situation, in that your grandmother is still living. Get this straightened out now. If you were smart, you would do this without developing any hard feelings. It is a very simple situation, so don't make it difficult. Everyone loses if you make it difficult. Buck's suggestion is a very easy solution. Follow that advice if nothing gets changed before her death.

  • Ask the third brother if you and the younger one can buy his 1/3 out and then you are home free for you both to live there, if you don't have the $ to buy out take a loan and pay him off, very simple, now isn't it, Buck
